Indianapolis — A judge has denied a gag order that would have barred the airing of a television interview with a woman who was shot outside a day care center
A lawyer for the woman's ex-husband who's accused in the shooting sought to bar the planned Thursday airing of Shirley Justice's interview with WTHR-TV.
Defense attorney Jackie Butler, who represents Christopher Justice, said the interview could prejudice jurors, but Marion County Judge Grant Hawkins denied her motion.
Indianapolis police said Christopher Justice, 33, shot Shirley Justice on Feb. 18 just after she had dropped off her two children at Eagle View KinderCare on the city's northwest side. Court records show the couple had been involved in a custody dispute over their 6-year-old daughter.
A message seeking comment was left with Butler's office.
