Former legal secretary Lacee Garber faces felony theft and forgery charges

A former legal secretary faces two felony counts of theft and one count of felony forgery alleging she mismanaged a deputy prosecutor’s private practice.

Kokomo police arrested Lacee M. Garber, 33, Russiaville, following a traffic stop at Park and Alto roads at about 5 p.m. Tuesday on a warrant issued out of Howard Superior Court 2.

Garber, the former secretary for Michael Krebes, a deputy prosecutor and private attorney, allegedly mismanaged his practice and stole thousands of dollars from several clients.

The charging information on the Class C felony forgery alleges that in December Garber, while working for Krebes, forged a client’s name on a $5,146.72 settlement check and deposited it in her account in order to pay her bills.

The theft charges, which are classified as Class D felonies, allege Garber made numerous personal purchases between February of 2012 and November 2013 using the law firm’s debit card to pay her personal bills. In 2012, Garber allegedly racked up $12,853.96 in purchases and $19,905.16 in 2013, the probable cause affidavit stated.

In addition, Garber made numerous ATM cash withdrawals totaling $11,997.75. In all, Garber allegedly stole $44,756.87.

In January, Krebes told the Kokomo Tribune that Garber’s alleged actions caused him to close the doors of his private office on Mulberry Street. He now rents office space on North Washington Street.

Garber also had worked part-time with the prosecutor’s office up until 2012.

Barry S. Brown, senior prosecuting attorney from Bloomington, filed the warrant Tuesday in Howard Superior Court 2.

Brown was appointed special prosecutor in the case since Howard County Prosecutor Mark McCann works with Krebes and has worked with Garber in the past.

Garber was released from jail after posting $2,000, 10 percent of the $20,000 bail. Her arraignment is set for July 22.

If convicted, she could face up to eight years on the C felony and up to three years on each of the D felonies. She also could be ordered to pay restitution to the victims.
